This position is responsible for supporting Asset Integrity Project Managers
and Engineers related to existing pipeline and facility in line inspections,
right of way clearing and maintenance, and depth of cover programs.
This position also supports Project Managers in environmental remediation
projects and pipeline relocation projects as well as general support of
Magellan staff in the acquisiton, and protection of Magellan's real estate
rights.
Acquire, dispose of and protect company real estate interests including fee
properties, rights of way, leases, licenses, and real estate related
agreements.
Receive real estate related requests from company and third party
customers; set up files; research company real estate records; evaluate
rights, duties, requirements and advisability of complying with requests.
Make contacts with people and gather the information and provide manpower
and management necessary to fulfill, modify or reject the requests.
Prepare real estate contracts and agreements to facilitate the exchange,
modification, acquisition, sale or release of company's land rights in support
of operations, system integrity, business development, environmental and other
company objectives.
Close file and merge relevant documents into company real estate database
and files.
Project Management: Perform due diligence and assume responsibility for real
estate issues and objectives in Asset Integrity projects. This process
includes the review of existing easement rights and documentation, research
and development of current land ownership, settlement of project related
claims, and the acquisition of additional rights to facilitate project scope
and schedule. This will include the negotiation of contract staffing
agreements, staffing of projects, budgeting and budget analysis, assisting in
the hiring of outside counsel and subsequent support of counsel and general
management of litigation associated with projects.
Represent company to third parties (landowners, tenants, governmental entities
and agencies, land developers, mineral developers, energy transportation and
utility companies) in matters related to company operations, company real
estate, and other company assets. Examples: Acquisition of real estate
interests, provide information on easement rights; amendments to or releases
of rights of way; encroachment removals; encroachment agreements,
reimbursement agreements, zoning issues, damage evaluation and settlement.
Provide support to Legal department for legal controversies, condemnations,
litigation and document preparation and review related to real estate issues.
Support of company operations personnel: Provide support for acquisition of
rights, entry, activities and damage settlements associated with in-line
inspection, pipeline repair and maintenance, cathodic protection systems, and
right of way clearing. Provide information on company easement rights and
encroachment removal and prevention.
Counsel and advise field operations, project managers, legal and management on
real estate matters including review of documents and plans; report and make
recommendations relative to projects, existing agreements or requirements for
new agreements affecting Magellan.
Research, investigate, document and negotiate contracts and agreements and
settlements concerning property rights and claims associated with projects.
Contracts and Agreements include: relocation agreements, encroachment
agreements, leases, licenses, eaesnments and right of way documents, access
agreements, bills of sale, options, deeds, assignments, releases, partial
releases, reimbursement agreements, relocation agreements, encroachment
agreements, divestiture agreements and purchase and sales agreements.
Review proposals, documents and construction drawings, conduct research,
evaluate sites or routes, report and make recommendations relative to proposed
or existing contracts and projects affecting Magellan's real estate needs or
rights. This process includes participating in route reviews and cost
analysis for feasibility studies, pipeline relocations and remediation
projects.
Understand, and analyze common types of legal descriptions. Evaluate,
appraise and negotiate the purchase or lease of land when new facilities are
to be built or when required in construction, relocation, acquisition,
divestiture or remediation activities. Evaluate, appraise, conduct courthouse
research of marketable title and negotiate the acquisition or relinquishment
of real estate interest.
Bachelor Degree is required with Juris Doctor, land management, business, or
equivalent degrees prefered. Senior Right Way Agent (SRWA) designation
prefered or active education towards achieving SRWA designation required as
approved by Management. Texas Real Estate registration for easement
acquisition in Texas.
5 to 10 years pipeline and/or terminal/faciltiy real estate related experience
or equivalent prefered. Knowledge of pipeline and/or terminal/faciltiy
operations, construction and evironmantal issues required. Education in
business, public affairs or administration related field, land or property
management or related field is preferred.

in stressful conditions; the ability to adapt and respond in changing
circumstances; the ability to use a personal computer with the Windows®
operating system to complete time sheets, send and receive email, and access
information posted on the Company's intranet; availability as needed to work
on both a scheduled and call-out basis; and the ability to work at the
assigned job site.
