We are currently looking for a Claim Counsel. Please read on for more details regarding this position.
JOB DESCRIPTION:
PURPOSE
Effectively manage all construction claims, typically of moderate severity or complexity. Fulfill Bond & Financial Products Claim’s mission by conducting thorough investigation, analysis, evaluation and disposition of claims to achieve superior customer service and claim results at the most reasonable cost. Interact and collaborate with claim, construction and underwriting colleagues as well as with external business associates. Knowledge of Construction Law is a must.
RESPONSIBILITIES
1. Thoroughly analyze, investigate, negotiate and resolve moderate severity construction claims with moderate supervision.
2. Make appropriate decisions within claim authority and make appropriate recommendations to management when necessary.
3. Comply with all policies and procedures, including compliance, regulatory and performance and customer service standards.
4. Accountable for accurate documentation/information in claim file adhere to documentation standards.
5. Prepare reports to management to accurate reflect loss development, potential/actual financial exposure, coverage issues, claim and recovery strategies.
6. Retain, monitor, manage and approve payments to outside counsel on litigation matters.
7. Ability to make quick, sound decisions and negotiate terms and conditions.
8. Assist/mentor less experienced colleagues in claim resolutions.
9. Maintain knowledge of surety and Coverage Law, Construction Law, legislative and industry-related initiatives and judicial trends.
10. Provide legal support to underwriting and claim business product line (e.g. legal research, case analysis, transactional support, legal advice, advice on litigation strategies.
11. Strong communication (written and verbal), influencing, negotiating, listening and interpersonal skills to effectively develop productive internal and external relationships
QUALIFICATIONS
1. Looking for an attorney with at least 5 years experience with construction and construction litigation.
2. Knowledge of moderately complex claims (e.g. non-routine, multi-party litigation).
3. Legal expertise in all aspects of the business and products.
4. Assures compliance with litigation management and budgeting plans, including fee audit.
5. Develops legal and claim strategies and implements within limits of authority.
6. Ability to use Bond technology tools, including Microsoft Office programs (Word, Excel, Power Point) proficiently.
7. For Claim Counsel Position - Law degree from accredited institution. Bar admission in at least one jurisdiction.
8. Knowledge of Construction Law is a must.
9. Strong communication skills (written and verbal).
