JOB DESCRIPTION
The Attorney will be a member of the legal staff of the Research and Investigations Division, a new unit created to investigate and expose, and to litigate against illegal, deceptive and fraudulent practices impacting on New Yorkers. The R & I Division, comprised of attorney and non-attorney staff, will engage in a range of in-depth research and investigations of emerging issues and trends. The Unit will also work in coordination with DCA’s Office of Financial Empowerment to stop abusive practices aimed at low-income consumers and will support the Department’s general law enforcement and public policy work.
Under the direction of the Director and Deputy Director for Research and Investigations, the Attorney will identify business practices that violate the New York City Consumer Protection Law and/or Administrative Code and negatively impact New Yorkers, and develop, and implement, legal and other strategies aimed at penalizing and deterring such practices. In addition to litigation, strategies can include proposing rules, commenting on proposed rulemaking by relevant agencies, working with industry to develop best practices and guidelines, and drafting fact sheets, reports and consumer tip sheets.
Daily tasks may include: (i) legal and fact-based research, including conferring with experts, community members and issue advocates, and reviewing consumer complaints; (ii) developing research and investigation strategies; (iii) guiding and advising investigators and interns; (iv) drafting subpoenas and other discovery requests, (v) preparing legal documents including briefs, motions, petitions, affidavits, memoranda ; (vi) preparing cases for trial and appearing in court and administrative hearings; (viii) negotiating and drafting settlement agreements; and (ix) recommending statutory and regulatory revisions.
PREFERRED SKILLS
1. Knowledge and experience in all phases of New York State court litigation;
2. Experience representing plaintiffs in advocacy-focused work;
3. Strong research, writing, and analytic skills;
4. Ability to work well in a team of legal as well as non-legal staff;
5. Demonstrated interest in/commitment to the practice of public interest law;
6. Previous policy-related/advocacy work (e.g., policy research and writing, drafting petitions to agencies, overseeing surveys;
7. Experience in business, consumer protection, or government agencies;
8. Tenacity, resourcefulness, creativity, flexibility, and the ability to work independently and quickly, sometimes under short
9. Ability to multitask and set priorities;
10. Flexibility in hours; and
11. Bilingual.
CIVIL SERVICE QUALIFICATION REQUIREMENTS
1. Admission to the New York State Bar; and either "2" or "3" below.
2. One year of satisfactory United States legal experience subsequent to admission to any state bar; or
3. Six months of satisfactory service as an Agency Attorney Interne (30086).
Note:
In addition to meeting the minimum Qualification Requirements:
To be assigned to AL II, candidates must have one year of experience at Assignment Level I or two years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment. To be assigned to AL III candidates must have two years of experience in Assignment Levels I and/or II or three years of comparable legal experience subsequent to admission to the bar, in the areas of law related to the assignment.
